Submitting a takedown notice
A notice must be in writing and include:
- Your physical or electronic signature (typing your full name is fine).
- Identification of the copyrighted work you say was infringed.
- The card or invitation you want removed, with its link (it contains “recipient-view.html?t=”), so we can find it.
- Your name, address, phone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
When we receive a valid notice, we turn off the card’s link and tell the sender, including who sent the notice and what was claimed. Please don’t send a notice unless you are sure: knowingly false claims can lead to liability under 17 U.S.C. § 512(f).
Counter-notice
If your card was turned off and you believe that was a mistake (for example, it is your own photo or video, or you had permission), you can send a counter-notice to the designated agent above. It must include:
- Your physical or electronic signature.
- Identification of the card that was turned off (its title and the date you sent it are enough).
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the U.S. federal district court for your address (or, if you are outside the United States, any judicial district in which PetalYou LLC may be found), and that you will accept service of process from the person who sent the notice.
We forward a valid counter-notice to the person who sent the original notice. If they do not tell us within 10 to 14 business days that they have filed a court action, we turn the card’s link back on.
Repeat infringers
We may pause or close the accounts of users who repeatedly infringe copyright. Generally, an account that receives three valid copyright notices can no longer send cards or invitations.
